The federal Trafficking Victims Protection Act (TVPA) allows victims of human trafficking to bring civil lawsuits against traffickers and those who benefit from trafficking ventures. Illinois also has strong laws prohibiting human trafficking, including the Illinois Trafficking of Persons and Involuntary Servitude Act. Under these laws, individuals who were forced to work under threats of harm, deception, or abuse of power may be entitled to damages even if they accepted employment voluntarily.
Common trafficking scenarios include workers being forced to work long hours without pay, having their identification documents confiscated, having their immigration documents withheld, being subjected to threats of criminal or legal action against them, or being subjected to physical threats, isolation, or control over housing and transportation. These conditions are often accompanied by wage theft, discrimination, and harassment. Even if a worker initially agreed to employment, if their continued labor is obtained through coercion or threats, it may qualify as trafficking under the law.
